The Bitterroot Public Library banned the letter to the first African American US President asking for civil rights. It is a reason not to recreate, move, nor accept employment in Montana.

The removed director of the Bitterroot Public Library said in sworn testimony that no staff had EVER asked Michael Spreadbury to leave the library...something required in the Policies of the Bitterroot Public Library and Montana Law: MCA 22-1-311 [Use of Library--Privileges].

On a summer day August 20, 2009 Michael Spreadbury was using his laptop on the public property owned by the City of Hamilton MT.

Without a trained view, someone charged with Trespassing on public property would be in violation of equal protection, and the act of peaceful assembly would be protected by the Federal courts. Think again. The US Constitution does not exist at the Bitterroot Public Library, or on a sidewalk in New York City for Occupy Protesters.

The same day, I went with a retired police officer, and my cameraman to explain myself, and the Montana law that says a library board is the only entity that can take your rights away. The Bitterroot Public Library can do what ever it wants because it is not an incorporated city, and the court case was mis-use of public funds....the #1 criminal priority of the FBI and the US Justice Department, but who's keeping track, especially at the Bitterroot Public Library.

I guess the question is do you ever want to go back to the Bitterroot Public Library when staff call you pathetic, publish this fact as you asked for the policy that was promised in the directors letter to you rejecting a written work such as a letter to the US president asking for civil rights?

Can you ever associate with the evil librarians who relish in charging a criminal charge for enjoying the public grounds, and not disturbing anyone? Can you ever understand why a city such as Hamilton MT would ever charge a crime for literally sitting peacefully on public property that you pay for by taxes? What is wrong with these people at the Bitterroot Public Library?

What is wrong with our police force who are supposed to protect people, yet instead conspire with the Bitterroot Public Library to take away rights to those who pay for the library and the police force?

As we got no answer from President Obama, and we watch as peaceful protesters are arrested for the same thing I was cited and prosecuted for: peaceful assembly at the Bitterroot Public Library.

In the last two editions of the Bitterroot Star, the Bitterroot Public library is claiming that they have funding "gaps" for their FALL FUNDING DRIVE. The only gap is the public misinformation about the Bitterroot Public Library budget.

Let me help you with that one.

In the 2009-2010 budget the Bitterroot Public Library had $500,000.00 US in the bank of your tax money. Apparently, this is not enough for a small one room library to operate with their $500,000 combined annual budget from Ravalli County and the magical unincorporated City of Hamilton. When the Bitterroot Public Library spends your tax dollars from the unincorporated City of Hamilton, MT and Ravalli County MT taxpayers purchases of books only amounts to 1 in 9 budget dollars.

I LOVE MY PUBLIC LIBRARY

The North Valley Library in Stevensville, MT has plans for expansion, has far superior community programs, staff, and operates on a fraction of the Bitterroot Public Library tax revenue (see link below for the North Valley Library). Moreover, The North Valley Library ACCEPTED the US President letter denied by the Bitterroot Public Library (link is below). Hamilton Montana is a community with many older seniors, so why shouldn't the Bitterroot Public Library seek those estates for use of their budget? How would the public know that the Bitterroot Public Library actually have a giant surplus? It is called deception at best, and fraud is not too far off.

In the 2009-2010 budget, 63% of the funds went to pay themselves (Administrative Costs). Lets compare the Bitterroot Public Library with the North Valley Library, a bigger, more community minded outreach, AND had plans to expand, with ACTUAL GAPS in their budget.

The North Valley Library is a great organization. Their volunteers laugh, are fun to talk to, and are helpful. Please give to the Stevensville Library if you have money to give. They operate a much better library with MUCH LESS tax revenue (or deception).

It is proof that the Bitterroot Public Library feels money from the public is theirs to spend, at their desire, and ask for more in Hamilton Montana. The Bitterroot Public library has another secret: Hamilton Montana taxpayers have footed a court bill for an estimated $250,000 for removing privileges, charging crime for sitting on public property as the former director admitted no requests were made to leave the library (under oath) for any behavior issue in violation of their policies, or Montana Law [MCA 22-1-311] which states a "willful violation of the rules" is needed prior to removal from the library. Many people in Hamilton were removed outside of this policy.

It is estimated that the Bitterroot Public Library has removed at least 10 patrons rights to enter the library, and the details are not known beyond that.

What is known is that the Bitteroot Public Library wants more of your gifts, be it your house or your hard earned money when they mis-use public funds as they violate Montana law, and patrons rights.

An upshot of the "Ban" from the Bitterroot Public Library has been the "Library Thing" website with a revolving readership of 3Million readers about the Bitterroot Public Library. The other upshot is the letter to the first African-American US President asking for CIVIL RIGHTS within the FIRST paragraph; the Montana US President letter has had more than 10 million confirmed views.

About 6 months ago, this blog network encouraged the boycott of the Bitterroot Public Library and a link to the reasons should make it very clear that something is very wrong in Hamilton Montana.

It just seems intuitive to give to a library. The Bitterroot Public Library is not an ordinary library. It has lost a director, and the state director for protecting the Bitterroot Public Library in Hamilton Montana. A library is for the public, to discuss ideas, obtain reading material, and congregate outside to enjoy peace. Peace is not what is at hand at 306 State Street in Hamilton Montana, site of the Bitterroot Public Library.

Please guard your finances from the Bitterroot Public Library. They have a right to ask you for money, but you have a right to know how public funding is being spent, or not being spent.

Angela Wetzsteon practiced without supervision as a law student in Ravalli County. Now she is a deputy prosecutor there. The problem comes when Angela Wetzsteon impersonated a state prosecutor August 8, 2007 as she was not licensed until October 9, 2008, and graduated from law school in May 2008. Do we let medical students practice medicine unsupervised?

Not on your life.

As Steve Bullock protected Angela Wetzsteon as Attorney General, not only is that unethical, but also harboring a crimnal: that means Obstruction of Justice for the Montana Governor candidate.

The Judge in the case felt that Angela Wetzsteon was the "state's attorney" in a sworn statement.

The Montana Consumer Protection agency under Steve Bullock feels that Angela Wetzsteon was acting under the Montana Student Practice Rule--which is really a court order #12982 from the Montana Supreme Court. The Tort defense division--Depatment of Administration under Steve Bullock's Attorney General office felt that Angela Wetzsteon as a part time county employee should be protected with state funds.

Violation of a court order is a crime, criminal contempt Montana Code Ann. MCA 45-7-309(c). If you do favors for the right people in Montana, you are protected.

The current county attorney, Bill Fulbright was supposed to supervise Ms. Wetzsteon, and didnt.

No other student in the University of Montana History has the school protected with online resources than Angela Wetzsteon. Nate Montana, Joe's kid who plays quarterback for the Montana Grizzly football team got a DUI in Missoula Montana (sorry Nate, this is to expose the University of Montana not you). Jimmy Wilson, was charged with some form of murder in Lancaster, CA and served two years. Jimmy Wilson now proudly plays for the Miami Dolphins in the NFL. This is an interesting web stat, as the collateral damage of lies of Lyme Disease in Montana is the lives of those who have it and are ignored treatment. As in the case of Randy Wilson of Interbel Eureka, Montana refusing to acknowledge that lyme disease exists and is deadly. Lyme disease is also suspected to be sexually transmitted as in some reports, and to cause fatal heart attacks and much more. NIH in Montana is to me, very dangerous.

When Under the Skin, the documentary on lyme disease came to Hamilton to interview those involved in Rocky Mountain Fever, and Lyme Disease Research ( which is why NIH Hamilton was started) well when the producer came to town, it is said that NIH officials came to his home to make sure that he said what they wanted him to say.

Dangerous Accident at RML

On May 7, 2012 the Rocky Mountain Labs held a community meeting. During the presentation the Biosafety manager Dr. Nancy Ho described an accident that the NIH facility was required to report to the US Center for Disease Control in Atlanta.

The accident was more than preventable, it should have never happened.

In fact, the Biosafety manager must be removed from her position. As this "professional" and others on her team did not catch the mistake of improper use of lab equipment--it is a BIG embarrassment to the National Institutes of Health at Rocky Mountain Labs.

If you look closely the blue and white box contain test tubes, and the item on the top, a PIPETTE was the culprit of the infectious agent breakage at a level 3 biosafety lab at RML Hamilton MT. The facility is a NIAID facility from the National Institutes of Health.

A glass pipette broke off as a researcher was attempting to stab, scrape or otherwise puncture a frozen layer covering the infectious agent for storage. Dr. Nancy Ho and her biosafety team felt stabbing infectious agents with 60% mortality rates was fine to continue, AFTER an accident happened. It should be noted that pipettes are used to transfer liquids, and have a tapered end like a eye-dropper, and would be a weak point on the device. As most High School students would understand using a pipette on non-liquids would be a problem, the top US researchers (with Ph'D degrees), and the top NIH biosafety people at NIH, CDC did not.

Interpretive Center proposed demolition is within a historic residential area did not include alternatives to the proposed demolition of the existing structure 801, 803 S. 4th.
In planning the new BSL-4 facility, NIH did not include professional fire, material safety personnel or fire structure assets at RML for safety, health of residents, employees.
The 20 year plan and FEIS does not include an emergency response structure at RML.
RML agreed to respect NEPA process, and uphold health and safety of community and RML employees in 2004 to resolve CV-04-154-M-DWM out of court.
NIH BSL-4 facilities in Frederick, MD; Bethesda, MD; and Raleigh-Durham, NC have sufficient fire assets due to being in larger communities which have training and equipment necessary to provide emergency assistance to comparable facilities to RML.
RML is located in an isolated valley with no professional fire departments, and no material safety teams within 45 miles, and 29 volunteer firemen in Hamilton, MT.
NIH headquarters house 30 federal firefighters, and can get assistance from the well equipped Bethesda (MD) Fire Department, located within 15 minutes from D.C. metro.
RML has no federal or professional fire personnel in any proximity to facility.
RML 20 year plan had no onsite emergency response facility although no adequate biological, materials, or radiological safety team is within 45 miles.
First Presidentially declared fire emergency was in proximity to RML, Ravalli County, and Montana in year 2000. Fire hazard is extremely high near RML.
RML is 45 miles from Missoula, MT with 60,000 residents and five firehouses. Materials safety team is currently dispatched from Missoula Fire Department.
Fallen timber block fire corridor route, accidents, and in-climate weather 3000 ft. AMSL, 47°Latitude; fire/materials response from Missoula not assured within 1 hour of dispatch.
RML without professional material safety, biological, or radiological staging area available on site, or within 45 miles of the Hamilton, MT facility.
NIH Office Research Safety issued Plaintiff false assurances of safety since 2007.
Plaintiff has adequately participated in administrative process by expressing concerns to RML, NIH in fire safety, environmental quality, NEPA director, Director of Research Safety, NIH legal counsel, and NIH Directors office.
Plaintiff has offered mediation to resolve this dispute to NIH.
No further remedy is available to Plaintiff to resolve NEPA and related safety issues.
FEIS and published NIH documents failed to adequately disclose, analyze, and assess environmental risk from proposed interpretive center demolition, parking project proposed by RML.
Risks from RML proposed interpretive center, parking lot projects have impacts to the environment, human health, and impacts to local governments.
Defendants did not comply with the NEPA act at RML.
Defendants have duty protect safety and health of employees, public around RML.
Defendants failed to answer electronic correspondence from Plaintiff addressed to askrml@niaid.nih.gov relating to fire safety.
Defendants do not pay taxes to local governments, nor payment in lieu of taxes (PILT) to defray wear on roads, fire response, and other costs.
Defendants are adding lab space at RML requiring more water resources, and have not addressed resource issue in the master plan, FEIS, or other published NIH documents.
Water discharge from RML facility, or monitoring is not published or public information.
Security of RML north boundary is substandard as non-fortified chain-link fencing.
Purchase of residential property for RML is not proper for federal industrial projects.
Industrial process as RML requires roof cooling fans, which impact bird habitat, and riparian, river area to west and surrounding RML and was not addressed in FEIS.
Use of NIH police vehicles except official use, outside RML property, improper."

The Lincoln County Police took a complaint regarding the Email account CrystalCoxIsABitch@Yahoo.com, the email account that threatened me, this proof is held by Bernie Cassidy, Lincoln County Attorney to protect and cover up crimes.

This is a brief and case before the Montana Supreme Court. All readers of this blog have to know is that local governments in Montana try to hide the bad acts of thier police, and administrative staff. While you can email Human Resources in most states, Montana has a code of protection where public information has to be fought for, and sometimes sued for.

Since the lawyers in Montana also go along (or they would not have a job) you have to go it alone against a judge, and most likely a PARTNER of a law firm. Well, I did just that and here is my story about a police report or two from the unincorporated city of Hamilton, MT.

Comes now, Spreadbury in the aforementioned case for public information, 42 USC§1983 with reply brief in support. Spreadbury seeks de novo review, remand in accordance with Montana Code, Montana Administrative Rules, Opinion of this court, State Constitutional right to inspect local government documents denied by Defendant Bell, City of Hamilton, Montana.

Statement of issues presented for review:

1. As unsolicited information is given to law enforcement prior to arrest, investigation, did District Court err in determining information privileged, confidential justice information as Montana Code Ann., Administrative Rules of Montana, this court’s decision in Sacco indicates otherwise?

2. If lower court Judge was married to librarian offering unsolicited information to law enforcement, issues opinion contrary to Montana Code, ARM, controlling authority of this court; is lower court Judicial opinion have appearance of conflict of interest?

3. As unsolicited information to law enforcement in aforementioned included suspicion of crime, initial information prior to warrant, arrest; does information in November 4, 2009 city police report qualify as “Initial Offense Report” constitute public criminal justice information?

4. As initial information was freely given to city police November 4 2009 without request to shield identity, privacy of public employee prior to arrest, investigation; does written law enforcement report as public criminal justice information by Montana Code Ann, Administrative Rules, or this Courts opinion in also overcome individual right to privacy of public employee?

Case Statement:

Spreadbury sought public information from Appellee Ken Bell former Hamilton City Attorney July 20, 2010 for two Hamilton Montana Police reports. The first Hamilton police report, Spreadbury took pictures on public property, not charged as a crime on February 13, 2009. The second police report occurred as a Librarian [former spouse of District Judge] and Hamilton City Planner gave unsolicited initial information of a suspected crime November 4, 2009 to the Hamilton Police without requesting confidentiality, or privilege at city police station. Spreadbury sought both reports from Bell, who refused five written requests over a period of six months, two written requests after disposition of case against Spreadbury October 15, 2010. Case asks court if rule of law, constitutional right to know in Montana was improperly applied by District Court as summary judgment.

Case Summary

This case is asking the question whether initial unsolicited information in police reports, prior to investigation, charge of crime, or arrest (describing initial facts of an alleged crime) considered public information by Montana Statute, Montana Administrative Rules, and this Court’s opinion. As Judge below was married to police informant, potential for Judicial conflict of interest arise in this case. Final judgment via summary judgment from District Court in conflict with Montana Code, Administrative Rules, and this court’s lawful authority for public information, right to privacy of public employees compared to public right to know.

Criminal Justice information, available initially to public (or by disposition of case) by Montana Code, ARM, this courts opinion. City, former City Attorney Bell failed to release information to Spreadbury depriving right to know, inter alia as pled in the amended complaint in the court below.

Case Argument:

I. Public Information releasable by Bell, City; information not released.

Spreadbury made five (5) written requests for information from City beginning July 20, 2010, ending December 1, 2010 consisting of two City police reports.

First Record Requested of Bell

Spreadbury requested a February 13, 2009 police report as pictures were taken on County property, no charges filed. Spreadbury’s employer was intimidated by City to discontinue employ as information was taken at time of “interview” with City Police. As Spreadbury’s request for police report was beyond a year from the date of incident, no misdemeanor charges could be brought by Bell by statute of Limitations in Montana Code Ann. MCA Title 45. Glenda Wiles, a public employee for Ravalli County called law enforcement due to Spreadbury taking pictures on lawn of Ravalli County Administration Building. As Spreadbury was never arrested, or charged with a crime for the February 13, 2009 incident City report can only be classified as public information Montana Code Ann. MCA§ 44-5-103(13)(a) et. seq. Spreadbury not under investigation for any crime as the July 20, 2010 and following written requests for the February 13, 2009 report. District Court erred in maintaining privacy of Wiles who does not have reasonable expectation of privacy under this Court’s two point test for an public employee’s actual expectation of privacy, and if that privacy is reasonable Bozeman Daily Chronicle v. Police Dept. 260 Mont. at 225 (1993).

As Glenda Wiles, Ravalli County Commissioner secretary called authorities while at official function, on county property Wiles has no expectation of privacy due to no sex crime, involvement with minor privacy, was no victim, and has a position of public trust as a public employee Bozeman Daily Chronicle at 227. District Court erred in granting privacy of Wiles for the February 13, 2009 City report.

Spreadbury avers Bell, as City Legal Department Head and City Attorney knowingly withheld with callous indifference to Spreadbury’s right to know; made official policy by deciding to withhold public information in violation of Oath of Office, Montana code, duty to Spreadbury Monell v. NYC Social Services 436 US 658 (1978). Bell displayed callous indifference towards Spreadbury in not releasing February 13, 2009 city report as five (5) written requests made of City prior to commencement of this action December 2010, allows municipal punitive damages from City to Spreadbury to deter future unlawful activity.

Second Report Requested of Bell

On November 4, 2009 Nansu Roddy, a librarian, and Dennis Stranger Hamilton City Planner entered the Hamilton Police Department to give unsolicited information about a suspected crime. Both Roddy and Stranger are public employees; Roddy of the City-County Library in Hamilton, MT and Stranger the “special projects” director for City. Unsolicited information to law enforcement prior to arrest has been found by this court to not be privileged under MCA§27-1-804 Sacco v. High Mountain Independent Press 271 Mont. 279 (1995). This court given judicial notice of the mis-information by City indicating the Sacco court did not include criminal justice information; initial information was given to the Bozeman Police Department about Sacco prior to arrest. An arrest, and criminal charges were later filed and dismissed. As Sacco was not under investigation at the time of her employer’s initial conversation with the Bozeman police that information was deemed not privileged, and Spreadbury argues initial information consistent with an initial offense report MCA§ 44-5-103(13)(i); ARM 23.12.201(3), ARM 23.12.202 is public criminal justice information.

Roddy fails this court’s two prong test in Bozeman Daily Chronicle (1993) for actual expectation of privacy and if that privacy is reasonable. Only reasonable expectation of privacy is sex crime, involvement of minors In RE: Lacy 239 Mont. 324 (1989). Roddy has a public trust position and works with children; as seven (7) false statements, false swearing MCA§45-7-202 as Roddy avers she went to the City Police “by herself” impeached by Stranger’s accompaniment with Roddy on November 4, 2009. The unsolicited information by Roddy, Stranger to the City did not include a threat, as City officer, now detective failed to obtain a supervisors signature to validate the report. The misconduct of Officer Brad Weston, the false information given by Roddy, Stranger as public trust employees is an issue of public concern and therefore City report becomes the highest rung of free speech available Dunn & Bradstreet Inc. v. Greenmoss Builders Inc. 472 US 749 (1985).

As Stranger gives six (6) false statements in City Report of November 4, 2009 is issue of public concern for Citizens of Hamilton, MT. This court found that Svaldi, an Anaconda School Teacher did not have any right to privacy for police reports and complaints as to her function as a public employee but appropriately protected the minors involved Svaldi v. Anaconda-Deer Lodge Co. 325 Mont 365 (2005) citing Jefferson Co. v. Montana Standard 318 Mont 173 ¶17(2003). City pleads to this Honorable Court that their decision in Bozeman Daily Chronicle 859P.2d 435 (Mont. 1993) gives protection to Roddy, Stanger (pg. 14 City Reply brief) but fails to mention the two prong test, or why public employees should enjoy privacy over the public right to know. Roddy, Stranger do not meet the Havre Daily News criteria for privacy for a public employee in Montana as neither are a victim, a witness nor have the availability to conceal misconduct of false information Havre Daily News v. City of Havre 333Mont 331 (2006). Bell was obligated by oath, adherence to Montana Statute to release information to Spreadbury, and had duty to approach court and failed MCA§ 44-5-303(2);(5)(a) see Oral argument (Doc. #34).

City avers throughout Reply brief of “threats” as holding public officials accountable for their behavior not an actual threat. Bell resigned his position, George Corn was relieved of his position as Spreadbury’s comment was predictive, City violates judicial economy of this court. Judicial Notice is given that no crime is on record for November 4, 2009 and no threat is available in public documents from the court, writs before this court attest (see www.findmythreat.com ). Spreadbury has no convictions, holds public trust national security clearance, made sworn affidavit of no criminal activity in Ravalli County Montana on November 22, 2011 under penalty of perjury (Appendix A pg. 2 #6). Further, City avers in discovery no other initial information of suspected crime November 4, 2009 other than requested report, confirms status of city report as initial offense report MCA§ 44-5-103 (13)(i) , ARM 23.12.201, Sacco; therefore public information. Bell, City should be found liable for negligence, callous indifference, decision as official city policymaker, violated Spreadbury established right to petition government, equal protection, Bell breached duty to release public information.

Assuming in arguendo November 4, 2009 was criminal justice information, disposition of case October 15, 2010 makes City liable for non-release of report as public information by Montana Code Ann. MCA§ 44-5-103 (10)(a). Spreadbury swears in affidavit (Doc. #18) two written requests were made of City after disposition of case. Bell was negligent in duties to release information for not approaching court to request release. If February 13, 2009 report was confidential criminal justice information, Bell had duty in Montana Code Ann. MCA§ 44-5-303 (5)(a) and failed to do so (see Oral Argument April 29, 2011; Doc. #34).

II. Initial Offense Report, Montana Code, Sacco Court require release of public information.

As November 4, 2009 City report, requested by Spreadbury on two occasions after disposition of case October 15, 2010 (see Doc. #18 Affidavit of Spreadbury) not released, City is liable to Spreadbury for injury, punitive damages to stop future behavior. Spreadbury was constructing 42 USC§1983 federal case against County (Spreadbury I) for relief in the Federal Circuit; Bell withheld information with knowledge of its suspected use. This court is given notice that Bell resigned his contract as City attorney prior to its term.

As City admits no other source of initial information November 4, 2009 Roddy, Stranger statements to City without requesting privilege are public ARM 23.12.201, Sacco. Spreadbury was not under investigation November 4, 2009, Roddy, Stranger give unsolicited information to City designated as Initial Offense Report MCA§44-5-103 (13)(i) public information in concurrence of the Sacco court of unsolicited information to law enforcement prior to investigation or arrest as not privileged. As no charges were filed for the February 13, 2009 incident, and Spreadbury requests information beginning July 20, 2010 city report is public information. Bell, City breached duty to Spreadbury in callous indifference as written requests were made from July to December 2010 (See Spreadbury Affidavit [Doc. #18]).

III. Bell’s Breech to Spreadbury and associated liability as Policymaker.

City, in reply brief gave false and misleading information to this Honorable court. An official Policymaker is official capable of speaking on behalf of the government, holds position as department head and can make policy for that government with any decision Monell v City of New York Social Services 436 US 658 (1976). Bell fits this definition of official policymaker for the City of Hamilton as City Attorney and Department Head for City Legal Department. Punitive damages attach to the municipality as policy or custom violates the established right of Spreadbury ibid. As Bell deprived Spreadbury’s state right to know (Art. II s. 9) City violates Spreadbury’s right to equal protection Amendment 14 US Constitution (Montana Constitution Art. II s. 4), acted in negligence, made policy for Spreadbury to not produce information which deprives right Streit v. County of Los Angeles 236 F. 3d 552 (9^th Cir., 2001).

Bell not in scope of duties as Spreadbury’s right deprived, Bell acted outside sworn duty as City Attorney. Bell not protected by MCA§ 2-9-305(5), no qualified immunity as Bell knew, should have known Spreadbury had right to public information as prescribed in Montana Code, Montana Administrative Rules, and this courts authority Harlow v. Fitzgerald 457 US 800 (1982). Judicial Notice is given that Bell resisted taking oath of office for first six (6) years stating in 2007 memo to City Council “It is ridiculous to think I have to swear an oath (of office)”. Bell’s belief due to Hamilton’s unlawful status as a municipality in Montana affirmed in official meeting by Mayor Jerry Steele August 2009 recorded on video.

City officials aware of unlawful status of municipality; no record of incorporation by way of MCA§ 7-2-4101 to 4105. Hamilton City annexed to Missoula Co. September 4, 1890 by James H. Hamilton sworn affidavit (see official map certified by Ravalli Co. http://www.youtube.com/watch?v=M07hBMWj3yU ).

Bell attests his belief of the futility to swear oath if Hamilton does not exist. As City obtains litigation fees to defend this case, becomes public fraud of Hamilton taxpayers and top criminal priority of the US Justice Department, top state official’s spouse sits on this Honorable Court: Justice Patricia Cotter. Tracey Neighbor Johnson esq. dares speak of Spreadbury’s background certified by the FBI in Washington DC as she knowingly participates in the top crime with Defense actors under the assumed protection of established law firm in Montana; Boone Karlberg PC of Missoula.

IV. Public Employees violating public trust have no expectation of Privacy

Commissioner Secretary Glenda Wiles has no expectation of privacy as “disorderly conduct” was called in as Spreadbury took pictures on County Property Bozeman Daily Chronicle 260 Mont at 225(1993). Spreadbury exercised right to expression, speech protected in Art. II s.7, Amendment 1 US Constitution. Wiles is not a minor, no minors were involved in February 13, 2009 situation; Wiles was no victim as Spreadbury had no contact, attempted to make no contact with public employees or hinder work of Ravalli County employees. Police report of February 13, 2009 is public information withheld by city.

Ravalli County cannot lawfully exist under MCA§7-2-2103 as Hamilton its seat does not have lawful incorporation documents.

Roddy, Stranger do not have expectation of privacy as misconduct: unsolicited false statements to City Police are not privileged Sacco, Bozeman Daily Chronicle, MCA§44-5-103(13)(i). The intention of the state constitutional Right to Know was to allow access, inspection to government documents to expose the misconduct; here by City actors. Art. II s. 9 states that no person can be deprived this right, regardless of race, color, ethnicity, criminal background (or in Spreadbury’s case allegation of criminal background). Bell swore an oath to uphold this right to Spreadbury, yet failed that duty.

V. Potential Lower court error, conflict, as Montana Code, Controlling Authority not upheld in District Court.

As District Court judge did not recuse himself immediately (or within 90 days) as former spouse was unsolicited information source, question of adherence to Judicial standard arises. The honorable courts have to abide by authority in legislature and statutory code; District Court disregarded public information statutes, Montana Administrative Rules, disregarded controlling authority in Sacco. The District Court attempt at entrapment, contempt as three (3) deputies in courtroom, two directly behind Spreadbury at July 20, 2010 Oral Argument (Doc. # 56) clearly showed bias and intent for harm. District Judge attempted entrapment in hearing as is reflected in transcript (Doc. #56). This Honorable Court is reminded that it controls the Judiciary in Montana, as it ignores its own rules for Student Practice (#12982), personal communication to former Attorney General McGrath about incompetent and corrupt law enforcement in Hamilton MT September 18, 2006, Orders of Protection are irrespective of pending charges, as no family tie, or relationship allows intimidation without keeping protection order Elden v. Bonemarte 162 P. 3d 847 Mont. (2007).

The order or protection for Elden struck down by this court as no family tie, relationship to invoke MCA§ 40-15-101 et. seq. Bonemarte apparently admitted to intimidating Elden: Roddy cannot claim any status as victim via threat or intimidation. Spreadbury never had relationship or dated Roddy, Stranger nor issued any communicated threat[1]. Spreadbury does not have to “collaterally attack” any intimidation charge that does not exist, but does not wish to try on any loafers for size at Boone Karlberg PC for public fraud.

District Judge Haynes dared Spreadbury to “send up” this case; Spreadbury humbly requests on behalf of Montana residents who remain restricted from public information in Hamilton Montana be protected by the laws, constitutionally protected right to know, prior opinions as directed by this Honorable Court. Spreadbury pleads for Statutory laws, created by Montana Legislature that govern public information be upheld by this court Wallace v. Helena Elect. Ry. Co. 10 Mont. 24 (1894).

Conclusion:

This honorable Court has made opinion, Montana Code Ann. indicates any information prior to investigation or arrest, after disposition of criminal case is releasable to the public as non-privileged. City did not release information, had callous indifference to Spreadbury about public information request. This breach of duty is actionable by punitive damages, municipal punitive damages as Bell was official policymaker for City and made decision to withhold information from Spreadbury. Spreadbury respects court for its careful consideration of this case as a matter of law, and lower court non-adherence to Montana Code, potential bias, Montana Constitutional right to know available to any citizen. Spreadbury sought, obtained public information within a week from Arizona, New Mexico without Constitutional right to know; public information is not confidential in Montana.

Open letter to Hamilton City and Ravalli County residents

This letter is communicate to readers of the Bitterroot Star, and the Bitterroot valley a situation that our public officials (including Governor Brian Schweitzer) chooses to completely ignore due to the “headache”. A copy of this letter is being sent to Mayor Engen of Missoula, who was gracious enough to meet with me in 2009 and might get a better reception with the Governor, and the Missoula County Commission.

The City of Hamilton claims they “incorporated” in 1894. Ravalli County was formed by the Montana Legislature on March 3, 1893. Hopefully by the last two sentences, many people are doing a double take. A county seat such as Hamilton cannot be formed a year after it’s county was.

As tax season is in full swing in April, many of us pay respective taxes to these local governments in this area. The problem arises as the requisite paperwork for Hamilton’s existence are absent, and are non-existent as was admitted in official meeting August 2009 by Mayor Jerry Steele and captured in the documentary “Beneath the Beauty” .

Montana Code indicates that a municipality in Montana such as Hamilton must have a census, petition, record of election, and notice of election to incorporate as is found in MCA§ 7-2-4101 to 7-2-4105. These items must be open to public inspection. Ms. Rose Allen Hamilton City Clerk, Ms. Regina Plettenberg Ravalli County Clerk do not have these items; we inspected the record prior to the 2009 Mayor election, including the Ravalli County Museum.

I purchased a certified plat map of the City of Hamilton on February 25, 2010. While I only wanted to authenticate the city property as publically owned, the map glaringly told a different tale: James H. Hamilton annexed the City of Hamilton to Missoula Co. by sworn affidavit on September 4, 1890. The map is available by searching the Youtube® website for “City of Hamilton, Montana” and viewing a short video of this map.

As we prepare for paying taxes on our properties to the “City” of Hamilton, and Ravalli County, the implication is that we are paying money for tax to a group of people pretending to have a government. The Feds like to prioritize their investigations, public or municipal fraud (misuse of public tax dollars by local government) is the number one (#1) criminal priority, followed by election fraud. As commissioner signs are put up, and Regina Plettenberg prepares for another county election (the #2 criminal priority) this area’s government is in denial of the realities and problems they are truly in.

Ravalli County government cannot exist without a legitimate seat per Montana Code Ann. MCA§7-2-2103. Matt Kanenwisher, and Suzy Foss have been consulted as to this issue and they assure me they take it seriously. My faith in a county attorney making opinion to eliminate his own job is tenuous at best. Instead of addressing the commission, I am electing to write this open letter to inform the public at large.

The Bitterroot Star, myself, the Ravalli County Watchdog site, and Judge Jim Haynes made opinion that public information is not released, nor is public money spent with proper and lawful public notice in Ravalli County. As law enforcement cannot restrain from tampering with evidence, nor students from practicing law, or a city attorney swearing an oath for seven years in office, a common theme is there: unlawful, unincorporated local governments have no obligation to obey the law or respect local taxpayers.

I have queried the Missoula Commission of their ownership of Ravalli County by annexation of Hamilton in 1890. Their response: they will let the Ravalli County Commission take the lead. A popular tactic is to “hold our breath” and wait for an issue to subside; your voice is needed now. As a messenger, it did not go so well as I attempted to put a letter to President Obama concerning the lack of civil rights in this county, and the ministrations of local law enforcement; ten to fifteen million readers are aware that Ravalli County has no incorporated seat. Only until recently has the connection been made regarding actual ownership of the City of Hamilton and the unlawful nature of Ravalli County by Montana Law.

While I care not for the partisan issues raised locally, I do care for the public taxpayer, and the lawful status of our governments. An unincorporated city cannot have elections, pay employees, or collect taxes. The same can be said for Ravalli County government. The Commissioners are not too keen on putting their pencils down or making efforts with the City of Hamilton to lawfully incorporate (or re-incorporate).

I ask that this issue is not allowed to be ignored. The incorporation process will ask people within the City of Hamilton if incorporation is the right move.

As a city resident, my choice would be to emulate Seeley Lake: no government other than Missoula Co. Are we better without any local government ? My opinion is that the City of Hamilton, and Ravalli County do more harm than good with our tax dollars. The staff of these governments like to gang up on, and abuse the very taxpayers that pay their salaries as public officials of governments locally that dont lawfully exist.

It is irresponsible for the Montana Governor to ignore this critical issue. The same can be said for the Missoula Commission: turning down tens of millions of tax revenue due to it being a “headache” is a disservice to its constituents. As a taxpayer, make your voice known to your unlawful governments to follow Montana Law, or disband.

Bias toward Spreadbury: Defendant law student, clinic attendee at US District Court for Montana, Missoula Division, paid influence by Montana Law School for US District Judge Malloy, US Magistrate Lynch, clinic director required recusal 28 USC § 455 et. seq. Defendants deprive established rights of Spreadbury with 4 unlawful criminal charges since 2007 protected in Amendments to US Constitution. Spreadbury has been subjected to 3 unlawful arrests, §1983 case pending in this circuit. Career, livelihood interference by Defendants pled in aforementioned Gabbert v. Conn 131 F. 3d 793 (1997). Facts of Current Case Before Court

Case and Controversy of Spreadbury v. Hoffman et. al. is before this court as Cause No. 10-36086 for 42 USC §1983, civil rights inter alia. Within the 2^ndAmended complaint, Spreadbury prays for the following injunctive relief:

1. Count 8—Ravalli County Attorney Office (RCAO)

Prosecutor Fulbright now elected County Attorney, admits to Defense Counsel: “If it were any other person but Spreadbury, charges would be dismissed. (in Appendix B Opening Brief of Plaintiff)”.

Fulbright did not adhere to discovery rules, speedy trial provisions at common law, has personal interest in Spreadbury’s unlawful conviction.

Angela Wetzsteon prosecuted Spreadbury as unsupervised law student, now employed as Ravalli County prosecutor, personal interest in conviction.

Spreadbury pleads in ¶109 2^nd Amended complaint: “RCAO has initiated action without probable cause against Spreadbury, more than reasonable belief it will continue….unless preliminary injunctive relief enjoined.”

Fulbright, Wetzsteon have personal interest in obtaining conviction, bias.

2. Count 9--Ravalli County Justice Court

Justice of the Peace in Ravalli County allowed unsupervised law student to prosecute law, denied motion to uphold Spreadbury’s 6^th Amendment protected in US Constitution (in Appendix B Opening Brief of Plaintiff). Spreadbury believed judiciary of Ravalli County would act with malice, did act with malice towards Spreadbury July 22, 2011 in arraignment for charges without probable cause, equal protection to protected interest in Amendment 5,14 US Constitution; lower court without jurisdiction.

Spreadbury pleads in ¶120 2^nd Amended Complaint of aforementioned conspiracy of Hamilton (MT) Police Department, Ravalli County Attorney Office (RCAO), Ravalli County Sheriff Office (RCSO), Ravalli County Judiciary will put Spreadbury in jeopardy of future constitutional deprivations. This Writ of Prohibition manifests this belief as reality.

Facts of Current Controversy

Spreadbury exercised right to free speech, protected 1^st Amendment US Constitution to write with chalk on public sidewalk June 29, 2011. No less than 15 peace officers from Hamilton City Police Department, Ravalli County Sheriff encircled, and detained Spreadbury. Spreadbury cooperated with officers, and remained calm. In challenge to unlawful detention, Spreadbury respectfully informed officers if no charge filed, practice deprived 4^th Amendment right to be free from seizures by government. Ravalli County Deputy caught up with Spreadbury and asked if he had written “all of the chalking”. Spreadbury answered in affirmative and Deputy ordered Spreadbury to stop. Charge of Disorderly Conduct, Montana Code Ann. MCA§ 45-8-101 and Criminal Mischief Montana Code Ann. MCA§ 45-6-101, both misdemeanors charged. Third annual “Daly Days” Chalk Festival held by Ravalli County Montana day after Spreadbury arraignment before Judge Burnsides, substitute Ravalli County Justice Court JP from Darby, Montana City Court.

Spreadbury plead not guilty in arraignment July 22, 2011to both charges without assistance of counsel, prosecution not present at arraignment. Judge Burnsides made aware of Spreadbury disability status, documented by Social Security Administration. Judge executed necessary paperwork, court restrictions, adjourns hearing. Outside official hearing, Spreadbury informs Deputy, few feet away of Chalk Festival in appropriate voice. Judge Burnsides receives ex parte communication from Deputy about communication with Spreadbury not related to case. Judge Burnsides recalls Spreadbury, finds Spreadbury guilty of contempt, without representation, although Justice Court contempt precluded as hearing adjourned, Montana Code Ann. MCA§ 3-10-401. Judge Burnsides ordered the unlawful arrest of Spreadbury, a disabled person per Americans with Disability Act (ADA) without representation, due process, probable cause (jurisdiction) protected in Amendment 14 US Constitution.

At Ravalli County Detention Center, Sheriff Hoffman, main defendant in aforementioned created instruction list, specific treatment of Spreadbury: no clothes, no toilet, no privileges, isolated confinement, withhold prescribed medications, mental health evaluation recommended general population; Hoffman over-rode with “policy or custom” depriving Spreadbury right not to be treated with cruel, unusual punishment Monell v. NYC Dept. of Social Services 436 US 658 (1978), Amendment 8, US Constitution. Ravalli County Deputy in confinement taunted/withheld Spreadbury prescribed medications by more than 24 hours; detention staff attempted to under-medicate Spreadbury with prescribed medication in Ravalli County custody.

Brief in Support

Spreadbury properly pleads for equitable, injunctive relief from Honorable Court in form of Writ of Prohibition in aforementioned as court below lacks jurisdiction, great injustice, irreparable harm will result if writ is not issued US v. Brooklier 685 F. 2d 1162 (9^thCir., 1982).

Traditional use of writ in aid of appellate jurisdiction both at common law and in the federal courts has been to confine an inferior court to a lawful exercise of its prescribed jurisdiction.

Roche v. Evaporated Milk Assn. 219 US at 26 (1943) citing Interstate Commerce Commission v. United States ex. rel. Cambell 289 US 385 (1933).

Spreadbury pleads to Honorable Court: Ravalli County, prosecutors in aforementioned established prior bias, willingness to deprive established right, prayer for equitable, injunctive relief ripe before this court, well established precedent met to implement Writ of Prohibition. Spreadbury aware issue of writ is matter of discretion with this court Pacific Car & Foundry Co. v. Pence 403 F. 2d 953 (9^thCir., 1968). Denial of writ leaves Spreadbury no appellate remedy for lack of jurisdiction, bias at Ravalli County Justice Court from no probable cause for Disorderly Conduct, Criminal mischief June 29, 2011by prosecutor Fulbright with personal interest in obtaining conviction of Spreadbury Rest 2d Torts §666. Act of writing on sidewalk without communicating credible threat, obscene language protected Amendment 1, US Constitution.

Issue of writ prevents Judge Burnsides from all manner of errors, including departure from natural rules of natural justice, misconstruing substantive law Pulliam v. Allen 466 US at 533 (1984). Issue of jurisdiction for Ravalli County Court, “michiefs of misconstruction” against Spreadbury prevented by prohibition requested herein Pulliam at 534. Judge Burnsides former Ravalli County Deputy, prior contact with Spreadbury; prohibition for bias of prior knowledge, conflict of interest, current unlawful judicial conduct prevented by writ Ibid at 535. Honorable court has availability of collateral injunctive relief in exceptional cases as two Ravalli County Justices announce recusal, Judge Burnsides fails to lawfully adhere to proper Juris Prudence, contain bias to Spreadbury as question of lower court jurisdiction arise Ibid.

Relief is constitutionally required, necessary to avoid irreparable harm to Spreadbury Pulliam at 539. Spreadbury has filed in the aforementioned before this court for relief 42 USC §1983 inter alia. Section 1983 causes of action excellent exception to the anti-injunction statute allowing Federal Courts to intervene for Federal rights pled by Spreadbury Pulliam v. Allen 466 US at 541 (1984). Spreadbury has pled for equitable, injunctive relief against Defendant Ravalli County actors; injunctive relief to protect parties before this court for unconstitutional action under color of law from all branches of government: Executive, Legislative, Judicial Mitchum v. Foster 407 US at 242 (1972).

A writ is not directed against a Judicial officer, but the nature of the thing to be done Marbury v. Madison 5 US at 170 (1803). Where Judge Burnsides directed by law to do a certain act affecting the rights of Spreadbury issue of Writ of Prohibition is proper Ibid at 171. When jurisdiction of lower court doubtful, no other legal remedy, Spreadbury subject to unlawful prosecution, lower court lacking jurisdiction from no probable cause, writ is proper Smith v. Whitney 116 US at 173 (1886). Honorable court has jurisdiction to issue Writ of Prohibition 28 USC § 1291 Ibid at 175. The Court may restrain the exercise of judicial function on court about to exceed its jurisdiction Smith v. Whitney 116 US at 176 (1886).

Writ defined, Montana Code Ann. MCA§ 27-27-101 International Brotherhood of Elec. Workers AFL-CIO Local 1638 v. Montana Power Co. 280 Mont. 55 (1996):

A Writ arrests the proceedings of any tribunal…exercising judicial functions when such proceedings are without or in excess of the jurisdiction of such tribunal.

Spreadbury is appropriately attaching writ to Ravalli County, not private party, court marshal in the aforementioned.

Before a Writ of Prohibition may be granted Spreadbury must demonstrate that the acts of public officials are clearly unlawful under MCA§ 27-27-101 Kimble Properties v. Dept. of State Lands 231 Mont. 54 (1988). Court below, Ravalli County Justice Court without jurisdiction of criminal charge TK-2011-1426 against Spreadbury without probable cause, unlawful at common law Id.

As Defendant Ravalli County effects malicious prosecution on Spreadbury with intent to deprive Spreadbury equal protection of the laws or is otherwise intended to subject Bretz, Cline, Spreadbury to denial of constitutional right “too striking to ignore” Bretz v. Kelman 773 F. 2d at 1031 (9^th Cir., 1985) citing Cline v. Brusett 661 F. 2d at 112 (9^th Cir., 1981). A thirty year history of deprivation in the State of Montana, in color of law, civil conspiracy involving Montana State actors, including the Montana Attorney General, Montana Chief Justice, ranking Montana US Senator: provided Presidential appointment in 2008 to University of Montana Law School Dean Edwin Eck to allow Defendant law student Angela Wetzsteon’s violation of Montana Student Practice Rule in conspiracy to deprive Spreadbury equal protection of the laws, malicious prosecution at common law that interfered with Spreadbury’s profession at the Federal Emergency Management Agency (FEMA) August 8, 2007 Gabbert v. Conn 131 F. 3d 793 (9^thCir., 1997). Defendant Law Student Wetzsteon, unsupervised as Defendant Fulbright, Defendant Corn failed to appear at Spreadbury’s trial in absentia August 8, 2007 for TK-2006-3068 without probable cause, in violation of inalienable right Art. II s. 3 Montana Constitution: healthy environment, protect property, Amendment 6 US Constitutionfor speedy trial, right to confront witnesses. Defendant Wetzsteon presented tampered evidence from the Ravalli County Sheriff Department outside discovery provisions, prompting Defendant Fulbright to say to Spreadbury’s retained counsel “If it were anyone else but Spreadbury, the case would be dismissed (in Appendix B Opening Brief of Plaintiff).”

Accordingly, Writ of Prohibition should issue to end litigation and save needless expense where respondent court could not render valid judgment because of lack of jurisdiction State ex. rel. Redle v. District Court in and for Missoula Co. 102 Mont. 541 (1936). Writ of Prohibition is a clear and indisputable right to relief when a lack of all means to redress wrongs Ibid.

Defendant Bill Fulbright, Ravalli County Attorney utilized Rest 2d Torts §666 effect of advice of counsel on existence of probable cause to charge Spreadbury with criminal act without probable cause Ravalli CountyTK-2011-1426. Fulbright has personal interest in obtaining Spreadbury’s conviction, established bias in prosecuting Spreadbury.

Law enforcement at scene of Chalk on Sidewalk did not know how to charge Spreadbury, called Fulbright Rest 2d Torts §666 for advice of counsel. Charges without probable cause deprive Spreadbury equal protection, denial of constitutional right of due process, equal protection Amendment 14 US Constitution. Ravalli County Deputy wrote “writing on sidewalk with chalk” on Citation (Appendix A) for Disorderly Conduct, Criminal Mischief.

The Arizona Court of Appeals held that a citation was insufficient to support lower court finding of probable cause, establish Spreadbury committed offense of Disorderly Conduct, Criminal mischief [Ravalli CountyTK-2011-1426]; protected activity of writing with chalk on public sidewalk Amendment 1, US Constitution, Otel H. v. Barton 93 P. 3d 512 AZ App. (2003). Citation did not contain any factual allegations that crime was committed, no affidavit to prove facts, conclusion of law Spreadbury committed criminal act Ibid. Whatever procedure a state may adopt, it must provide fair and reliable determination of probable cause (herein and in Felony Intimidation DC-09-154 in the 21^st Montana Judicial District) as a condition for any significant pre-trial restraint of liberty (Appendix A, B) US Amendment 4, Gerstein v. Pugh 420 US 103 (1975). Spreadbury subject to 3 weeks pre-trial detention Montana 21^st District DC-09-154; 19 hour lockdowns pre-trial, inmate # 311635 Missoula County Detention Center November 9 2009 to December 3, 2009. Writ to Supreme Court State of Montana was denied in DC-09-154 (Appendix D), sentencing Judge Harkin “did not want case out of Montana” or transferred out of state at hearing October 15, 2010 due to it being “...a local issue.” State of Montana ranks 48^th in continental US for Justice, [US Justice Dept. 2007]. Spreadbury had no choice to plead due to jury tainting by Defendant Newspaper in Spreadbury v. Bitterroot Public Library et. al. 9:11-cv-00064-DVM-JCL US District Court for the State of Montana Missoula Division.

Spreadbury pleads irreparable harm, large civil conspiracy in color of law, no jurisdiction of Ravalli County Justice Court in TK-2011-1426, no appellate remedy due to immediate risk of revocation of deferred sentence, conviction of felony, prison sentence for protected act of free speech requesting help from Librarian in public, chalk on public sidewalk (Appendix A, D) exercised by Spreadbury in Ravalli County Montana. Issue of Writ of Prohibition proper, meets standards since US Supreme Court precedent established in 1803.

Hamilton, Montana- Ravalli County Attorney George H. Corn, nominated William "Bill" Fulbright, a prosecutor from Hamilton as the Montana Coalition Against Domestic & Sexual Violence (MCADSV) “Prosecutor of the Year”.

Bill Fulbright has been a prosecutor in Hamilton for the past 5 years, according to Joel Gallob, reporter for the Ravalli Republic.

Gallob does not site any other references besides prosecutors from the Ravalli County Attorney office in his story from October 8, 2007 published in the Republic.

Comment was not available from Kelsen Young, Executive Director of MCADSV from Helena, who gave the award Friday in Hamilton.

Bill Fulbright as Deputy Ravalli County Attorney violated the basic rights of a defendant in a case where prima facie evidence, that is, evidence to proceed with trial was lacking. In a statement made to defense council Sasha Brownlee[1] prior to trial, Fulbright exclaimed that “… if this had been anyone but (Spreadbury) the case would be dismissed.” This statement is evidence that Bill Fulbright does not respect the rule of law, and prosecutes with malice.

Further this statement violates the Montana Constitution Article II section 4 with respect to equal protection under the law. The same legal provision of equal protection is found in the 14^th Amendment of the US Constitution.

Bill Fulbright Deputy Ravalli County Attorney demonstrated further evidence of malicious prosecution when he asked a county judge, JP Jim Bailey to violate rules of the court as they pertain to evidence.

In a motion dated July 30, 2007 in State of Montana v. Mike Spreadbury case #TK 2006-3068. Bill Fulbright asked a judge to break the rules of the court for evidence when he failed to submit discovery, a responsibility of the prosecutor on any case.

When discovery is not submitted, that is immediate grounds for dismissal. When Ravalli County is involved however, anything apparently goes. [Angela Wetzsteon was allowed to practice law unsupervised]

Dean Eck of the University of Montana-Missoula School of Law states that when a lawyer initially makes false statements to judicial officers, then they are liable for ethical breech of the Montana Bar Association. Shawna Ryan, administrator for the Montana Bar in Helena, MT could not be reached for comment.

George H. Corn, the nominator for the award, asked the judge for the same evidence request (on the same day) when Bill Fullbright Deputy Ravalli County Attorney was denied on July 30.

As with his nomination for the prosecutor award, George H. Corn gets what he wants whenever he asks. Kathy Seeley, Assistant Attorney General for the State of Montana, and Josh Van De Wettering US Attorney in the Missoula office, in letters dated in April and September respectively state that George Corn has “wide latitude” in performing duties as County Attorney for Ravalli County, which seems to mean that he is above the Montana and US Constitutions. With the State of Montana and the

Justice Dept. protecting them, an award is small work for George H. Corn.

A defendant’s 6^th Amendment right to speedy trial was intentionally violated in the above mentioned case by the Prosecutor of the year, William Fulbright. Initial appearance was on January 5, 2007 and

Justice Court“trial” was on August 8, 2007. Seven months is far greater than the 6 months required by speedy trial provisions. This amendment was written by the founding fathers to protect against false charges, and their associated damages to the citizen.

Article II Section III of the Montana Constitution gives inalienable rights to Montana citizens. The provisions are for a healthy environment, and to appropriately defend property.

William Fulbright, and George H. Corn were petitioned by 10 Ravalli County residents in July 2006 in a community nuisance petition[2] to uphold these citizens right to a healthy and safe environment.

The RCAO ignored the petition, and decided to prosecute without evidence, which violates rule 3.8 of the Montana Bar Association for prosecution without probable cause. Preamble to the Montana Bar code of ethics is subsection (6) which states that the law should not be used to intimidate or harass individuals.

Obviously the Montana Bar association rules, the Montana Constitution, nor the US Constitution applies to the prosecutors in Ravalli County.

Can a lawyer who wins a prosecutor of the year award violate the basic protections available to Montanaresidents, and American citizens? When RCAO help themselves to a prosecutor award it is mere peanuts in comparison to helping themselves to people’s rights.

(Bill Fulbright won election for Ravalli County Attorney in 2010 on the premise of protecting peoples rights--a classy politician really because Ravalli County has no rights to speak of, and Bill Fulbright is not bringing Ravalli County any closer to America and the guaranteed, protected rights in constitutional documents--its still cash for crime).

It came to my attention that Ravalli County Commissioners get "training money" to train volunteer firemen in Ravalli County and Hamilton Montana to show up for a 21st century NIAID infectious laboratory within the City of Hamilton, Montana. This city does not lawfully exist via incorporation, which nullifies Ravalli County Montana as a government using Hamilton as a county seat (see Montana code reference below).

I made FEMA aware that the city of Hamilton has never lawfully incorporated as admitted by Mayor Jerry Steele in public meeting August 2009 during filming of "Beneath the Beauty" documentary [available www.BeneaththeBeauty.com ]. Montana Code indicates in MCA 7-2-4101 to 7-2-4105 that certain items are public record of incorporation, and Hamilton does not have these required items. A certified plat map of Hamilton indicates the city was annexed to a county to the North, Missoula Co. on September 4, 1890, without incorporation since. Ravalli County Clerk Regina Plettenberg does not have record of lawful incorporation for Hamilton, MT.

My complaint # C1205622 is lodged with DHS FEMA's OIG for the $200,000 grant to a local government subdivision which does not lawfully exist (Hamilton, Ravalli Co.) The monies from DR-1340-MT the year 2000 wildfires should be investigated and returned to FEMA due to local government unlawful status.

The law for excluding Ravalli Co. due to non-incorporation of the county seat (Hamilton) is Montana Code Ann. MCA 7-2-2103. This is to indicate to the NIH that giving monies to volunteers to fight infectious agents at Hamilton, MT is fraud, endangerment of citizens, and wrong on several levels [a disgrace to government scientists].

The city of Hamilton cannot respond to the lab unless life or property is threatened, from State statutes for volunteer fire. Monies from NIH to city or county governments is a fraudulent transaction, including water supply to RML to wash bubble suits. Sound fraud measurements of February 2, 2011 written up in report February 11, 2011 defrauded the public of accurate sound emissions coming from the NIH RML facility. RML is currently endangering the health of proximity residents of the Hamilton facility by way of low frequency noise (headaches, added stress, blood pressure, depression, more). The directors of RML/NIAID are encouraged to save the funds given to local governments, and build a federal fire/haz-mat protection facility on RML in Hamilton, MT, in addition to engineering sound structures to contain the RML emissions to a standard that does not affect the health of local taxpaying Americans.

At this time, NIH has not covered for its liabilities in the Hamilton MT area. Giving monies to local non-existent governments contributes to the fraud, and endangerment of American citizens near and working within the RML facility.

This information comes from a Bethesda, MD information officer from the National Institutes of Health due to the Public Affairs employee, Ken Pekoc refusing to give information as to why these Hamilton Police vehicles were parked on federal property.

During this call Marc Randazza said that if he took the case he would need money for a certain amount of costs and that it would be an expensive case to file appeal. He said, in a case like this he would normally charge at least $75,000. However, he was considering Pro Bono due to the Media attention I was getting, but even in that would need cost for copies and to be in a hotel in California for the appeal, if he or someone he recommended were to take the case.

Marc Randazza gave many signs during this call that Marc Randazza would most likely not represent me.

During this call Marc Randazza said he was concerned of the “record” and had to take a look at it before deciding. I said that was a responsible thing to do, he said he would look at my documents and get back to me, he did not get back to me, yet told others he represented me, more on that in a bit.

Marc Randazza told me on this call that I had “made a mess,” which I found very slamming as what I do is for the Greater Good and what I was exposing was and is on the right side of the law and certainly on the right side of the Moral Compass.

Big Media wants to shut me up, so they lie about me, and for some reason Marc Randazza ate up what Big Media said about me, even though it was NOT True. Marc Randazza did not care about my side. Marc Randazza simply ran me over with his personal opinions and agenda.

Marc Randazza told me that he used to work for Big Media but now he works for bloggers and porn stars, because Marc Randazza claimed that Big Media had the agenda of creating a Monopoly so they make more money. Yet NOW Marc Randazza is working with the Plaintiff in Obsidian V. Cox.

Marc Randazza told me that he would have to talk to his existing clients, such as The Media Association of Bloggers, to see if there was a conflict before deciding to represent me or not. Marc Randazza claimed he would get back to me on this. Instead, Marc Randazza contacted the Plaintiff’s side and tried to cut a deal WITHOUT my Consent, without “getting back to me” and without discussing if he represented me, wanted to represent me or if there was a Conflict.

Meanwhile Marc Randazza, of The Media Bloggers Association (MBA) , told lots of people in the “business” that he represented Blogger Crystal Cox, yet that was NOT True. I had agreed to work with another Lawyer and this created a situation that caused me stress, and almost lost me the Lawyer I really wanted.

Did Marc Randazza have to “discuss” a conflict with the Media Bloggers Association (MBA) in any way BEFORE Marc Randazza called the Plaintiff’s side and tried to work out a deal, as if he represented me? I was told at that time by other members of the First Amendment Bar that Marc Randazza was talking with the Plaintiff’s side and trying to work out some arrangement regarding money, or a change to case law. I was Pro Se for a year and I wrote over 50 Court Filed Documents myself. I was and AM in the KNOW on my Case and Marc Randazza simply left me out, as if I had no brain, no rights and with total disrespect for me, Blogger Crystal Cox.

Marc Randazza simply and certainly unethically took it upon himself to contact the Plaintiff’s side of Obsidian V. Cox, without my knowledge and without getting back to me on if he wanted to work with me or not, Marc Randazza simply left me hanging with time running out and was working behind my back on a deal. Is this Legal? Well it is certainly NOT Ethical and certainly shows no respect for bloggers nor the First Amendment Rights that Marc Randazza, Allegedly wants to protect.

Also on that first phone call Marc Randazza said he thought it was funny that the Plaintiff thinks they can get $2.5 Million out of me, and now Marc Randazza has offered himself up to help them get any assets they think I have and ESPECIALLY that $10 Domain Name, Marc Randazza .com, that dumb shit Marc Randazza NEVER Registered for himself. Marc Randazza is helping the Plaintiff to take Domain Names, which is my only way to make a living, and all in the name of “Constitutional Rights” What? This makes no sense and is NOT True.

Marc Randazza is Vindictive, plain and simply. He was not chosen in the BIGGEST case that the blogsphere has EVER seen regarding one blogger, and a case that will change laws and is already a world wide phenomena and that blogger, me, had the nerve to buy Marc Randazza .com and to even suggest that Marc Randazza hire her to do PR for him. Marc Randazza is so mad that Marc Randazza is making ALL Bloggers the Collateral Damage of Marc Randazza’s EGO.

In one of Marc Randazza’s last communications to me he said “do you really want to make an enemy of me?” Marc Randazza thinks that a blogger, a woman being smarter than him is making him an enemy.

So Marc Randazza is on a mission to teach Blogger Crystal Cox a lesson and be “Deposed” to rant about me to the Plaintiff to attempt to further quash my “Free Speech” and First Amendment Rights, and thereby affecting all BLOGGERS and Alternative Media Worldwide.

Marc Randazza told me that if I appeal it MAY create Bad Law and that maybe I should consider NOT appealing so that my case can be used to Lobby for others in changing laws. I was in agreement, and told Marc Randazza that I simply wanted advice from those surrounding the First Amendment Rights Issue and the First Amendment Bar, so that I could do what was best for all Bloggers, Citizens Journalists and the First Amendment Rights of All. Marc Randazza said he was very glad to hear that, and it made him want to work with me even more.

Marc Randazza said, if I take your case then my Ethical Duty is to you, yet Marc Randazza acted as if he had taken my case, without talking to me about it, and was already negotiating with the Plaintiff’s side of Obsidian Finance Group Vs. Blogger Crystal Cox.

To me, Crystal Cox, this says that Marc Randazza was already acting as my attorney, and did have an Ethical Duty to me to not disclose my stance, emails, or private conversations with him. Yet Marc Randazza contacted the “Other” side to Negotiate, and that was in December. Now Marc Randazza is using information I gave him in a Deposition that Marc Randazza is giving the "Plaintiff" to attempt to put me in my place and to take a $10 Domain Name that Marc Randazza was not smart enough to buy, and this, in my opinion, is an Ethical Breach, if not Plain Ol’ Illegal.

Last December I found out that Marc Randazza was Negotiating with the Plaintiff’s Side OF MY LEGAL CASE without my PERMISSION. I was told this by other members of the First Amendment Bar that wanted to represent me. They had heard that Marc Randazza represented me and even spoke with Marc Randazza, and he had flat out claimed to be representing me, yet Marc Randazza had not told me he was even still considering representing me, Blogger Crystal Cox. I was told by other Attorneys that I needed to let Marc Randazza know that he did not represent me, because Marc Randazza was telling everybody that he did represent Blogger Crystal Cox on Appeal of Obsidian V. Cox (I have Emails and more to Prove this).

Marc Randazza has so little respect for potential clients that Marc Randazza simply does as

Marc Randazza pleases without his client’s or potential client’s knowledge.

Can I Sue Marc Randazza for trying to make a deal, acting as if he was my attorney without my consent? I certainly can file Bar Complaints in NV, CA, MA, FL, and AZ to Start.

Marc Randazza is now part of a Witch Hunt to discredit blogger Crystal Cox, in effort to protect Big Corporations such as Obsidian Finance Group, Pacific Power, Government Oversight people such as Judge Randall Dunn and Pamela Griffith of the Department of Justice and Law Firms such as Tonkon Torp, Sussman Shank and Perkins Coie.

Marc Randazza is sacrificing the Free Speech rights of ALL in Marc Randazza’s own personal Ego trip over a blogger that bought Marc Randazza .com. Marc Randazza is NOT a man for the rights of Free Speech. Marc Randazza is a man for the personal EGO Trip of Marc Randazza.

So how is Marc Randazza working with the “Bad Guys” and on the Opposite Side of Free Speech?

Marc Randazza is helping the Plaintiff to set me up. Marc Randazza is pretending to be under subpoena and pretending to have no choice, but the truth is that Marc Randazza called the Plaintiff, and Marc Randazza initiated dealing with them against me because his EGO is bent that I did not CHOOSE him and I bought Marc Randazza .com. Marc Randazza is even flying to Portland to be deposed at the Tonkon Torp Law Firm. Gee I wonder whose dime this is on? And all this because they want to Silence a Blogger Exposing Corruption and to spite a Pro Se Defendant who went with a different lawyer and bought the whiny baby’s name as a dotcom.

According to wikipedia.org, Marc Randazza’s first case was representing a fraternity at Boston University, when the brothers of that fraternity were accused of destroying a house they had rented and accused of other misconduct. Marc Randazza then began practicing in Florida as a real estate attorney. Marc Randazza seems to have started right out working for the wrong side of the law and certainly the wrong side of the law in representing drunken fraternity brother’s who seem to have destroyed some one’s property.

Marc Randazza, according to wikipedia, “Soon thereafter, moved to Orlando, Florida where his practice in First Amendment and media law expanded. He started representing defendants in SLAPP suits, pornography businesses, and protesters, in often unpopular constitutional law matters.” Marc Randazza seems to have started right out of the gate on his First Amendment Soap Box defending those seemingly on the wrong side of the law and the wrong side of the moral compass. Marc Randazza is a Public Figure, indeed having been in debates on Fox news and other television and having worked for Big Media as Marc Randazza told me. So why are there not more bloggers EXPOSING Marc Randazza ? Well I guess, Marc Randazza really was for blogger’s rights, until he got all BENT over Blogger Crystal Cox and decided to be part of taking down the Free Speech Rights for ALL Bloggers.

Yes, I am under the impression that back in December, Marc Randazza contacted the Plaintiff to make a deal on my behalf for them to change the judgement so it would not affect the Porn Industry Free Speech, and this was to be in my best interest. And I was told that at that same time Marc Randazza claimed to many in the First Amendment Bar, that he represented me, and yet Marc Randazza had not told me, the “Alleged” Client. In my Opinion, based on my personal experience I do not recommend nor trust Marc Randazza.

Marc Randazza, seems to me to work on the OPPOSITE side of Free Speech in order to teach a female investigative blogger a lesson for being smarter than him.

"Jason Stverak, president of the Franklin Center for Government and Public Integrity, recently wrote a Washington Examiner op-ed regarding the free speech threats which bloggers and other citizen journalists increasingly face.

This past December, federal judge Marco Hernandez of Oregon issued a ruling in the libel trial of Obsidian Finance Group v. Cox that has dangerous First Amendment implications.
Hernandez ruled that blogger Crystal Cox was not entitled to the same protection under media shield laws that other members of the press enjoy. This ruling made it easy for a jury to find her guilty of libel. That result threatens the First Amendment rights of all citizen-journalists.
With the Internet increasingly serving as the dominant source of information, a national debate has been taking place asking the question, who is a journalist? Legal scholars, journalism academics and First Amendment advocates all have their opinions and as expected, there is little agreement.
But why is this issue so complicated? Bloggers, like all citizens of the United States, have First Amendment rights. Has the definition of a journalist changed? Or has perception and therefore legal definition simply not adjusted to modern technology?
According to Professor Kyu Ho Youm of the University of Oregon School of Journalism and Communication, Judge Hernandez “ruled correctly” in the Cox case. But he also acknowledges that the ruling was based on his “textual interpretation” and that “pre-Internet law needs updating.”
Youm offers a wake-up call to state legislators. Media shield laws must be revised to make clear that bloggers and all citizen-journalists deserve the same protection as the city hall beat-writer at the local newspaper.
This is especially important, as technology and new economic realities have forced newspapers all over the country to cut staff drastically and in many cases, close up shop. The public now relies on citizen-journalists to perform an invaluable service to our democracy — serving as government watchdogs.
